Starting on January 1, 2023, the federal government’s ban on anyone who isn’t a Canadian citizen or permanent resident from buying residential real estate for two years will be in effect.

  • The period will last two years.
  • The ban will only apply to residential property.

A non-Canadian means:

  • an individual who is neither a Canadian citizen nor a person registered as an Indian under the Indian Act nor a permanent resident;
  • a corporation that is incorporated otherwise than under the laws of Canada or a province;
  • a corporation incorporated under the laws of Canada or a province whose shares are not listed on a stock exchange in Canada for which a designation under section 262 of the Income Tax Act is in effect and that is controlled by a person referred to in paragraph (a) or (b); and
  • a prescribed person or entity.

There are exceptions, which include:

  • A temporary resident within the meaning of the Immigration and Refugee Protection Act; or
  • A non-Canadian who buys residential property with a Canadian spouse or common-law partner if the spouse or common-law partner is a Canadian citizen or permanent resident, or person registered as an Indian under the Indian Act.

A residential property Means:

  • a detached house or similar building, containing not more than three dwelling units;
  • a semi-detached house, rowhouse unit, residential condominium unit or other similar premises, vacant land, where the land has been zoned for residential use or mixed use and is within a Census Metropolitan Area or Census Agglomeration; or
  • any prescribed real property or immovable.

BC Premier David Eby introduced measures to increase housing supply in the province. These measures seek to end rental restrictions in all stratas, and limit age-restriction bylaws to deliver much-needed rental supply.

Rental restriction bylaws have been banned in strata corporations formed since January 1, 2010. These new changes extend the ban on rental restrictions to stratas formed before 2010. 

If approved, the changes to the Strata Property Act would take effect immediately.

Important changes are:

  • end all strata rental-restriction bylaws; and
  • limit age-restriction bylaws

Exceptions:

  • Age 55+ stratas will still be allowed
  • Bylaws restricting short-term rentals, such as Airbnb’s, will continue to be allowed

How much is a duplex in Burnaby as of today, November 21, 2022?

Well, let's first look at what is a duplex. A duplex is two dewelling units attached together. They can be atttached; side-by-side, front-back, or even stacked top and bottom.

In Burnaby we typically see side-by-side duplexes, and also front-back arrangements in smaller duplexes. Each side having its own P.I.D., title, and different owners (unless you own both sides). 

Let's check out the TOP 5 highest sold price duplexe in Burnaby from January 2022 to November 2022:

  • 4988 INMAN AVENUE
  • 5617 OAKGLEN DRIVE
  • 5971 PORTLAND STREET
  • 6455 WINCH STREET
  • 5969 PORTLAND STREET

The above 5 duplexes have a combined average sale price of $2,135,000. They are mostly newly built homes except for 4988 INMAN AVE, which is 6 years young at the time of the sale. Do keep in mind these homes are most likely GST applicable so 5% will have to be added onto the sale price, and don't forget the Property Transfer Tax (PTT) as well.

Of course not all duplexes will cost over 2 million dollars, some will be more affordable, it all depends on the age, size and location.
